In a story that moves from the virtual to the very real, Nintendo of America has launched a lawsuit against the U.S. government. The legal action targets several federal departments, including the Treasury and Homeland Security, over tariffs imposed by executive order in 2025. As reported by Aftermath, the core of Nintendo’s complaint is a challenge to the “initiation” and application of these tariffs on the import of its video game hardware.
This is a significant and rare move for the famously corporate-cautious company. The outcome of this case, which is currently pending the results of another tariff dispute, could have massive implications for the pricing and availability of Nintendo consoles—including the newly-launched Switch 2—in the vital North American market. For now, Nintendo is fighting back in court, arguing that the tariffs as applied are unlawful.
